Definitions

"Software" refers to the Arc application developed and distributed by Cubewise CODE Pty Ltd. "End-User Features" means the features accessible to all licensed users. "Developer Features" means features available to users with an active Developer subscription. "Vendor" means Cubewise CODE Pty Ltd, Level 11, 99 Mount Street, North Sydney, NSW, Australia.

Trial Licensing — Organisations

Organisations may evaluate Arc on a single computer for a period of 90 days. After the trial period, continued use requires a paid subscription. Contact software@cubewise.com for licensing options.

Trial Licensing — Individual / Contractor / Consultant

Individual developers, contractors, and consultants may evaluate Arc for 90 days across unlimited client sites. After the trial period, continued use requires a paid subscription.

General Use of License

This EULA grants you the right to use the End-User Features of the Software in perpetuity subject to acceptance of these terms. A Developer subscription grants you the right to use Developer Features and receive upgrades to the latest version for the duration of the subscription.

Copyright

Arc is owned by Cubewise CODE Pty Ltd and is protected by copyright law. You may not copy, modify, merge, distribute, or reverse-engineer the Software except as expressly permitted under this agreement.

Disclaimer of Warranty

The Software is provided "as is" without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event shall the Vendor be liable for any claim, damages, or other liability arising from the use of the Software.

Governing Law

This EULA is governed by the laws of New South Wales, Australia. Any disputes arising under this agreement shall be subject to the exclusive jurisdiction of the courts of New South Wales.
