By downloading Pulse you agree to the following End User License Agreement (EULA). Please read it carefully.
Definitions
"Software" refers to the Pulse application developed and distributed by Cubewise CODE Pty Ltd. "End-User Features" means the features accessible to all licensed users. "Vendor" means Cubewise CODE Pty Ltd, Level 11, 99 Mount Street, North Sydney, NSW, Australia.
Trial Licensing — Organisations
Organisations may evaluate the Software for the purpose of evaluating its features and capabilities only. The evaluation period is limited to 90 days and may only be installed on one server within your organisation. Payment for the Software under a subscription period entitles the organisation to use the Software for that period only.
General Use of License
This EULA grants you the right to use the End-User Features of the Software in perpetuity subject to acceptance of these terms. A subscription grants you the right to use all features and receive upgrades to the latest version for the duration of the subscription.
Copyright
Pulse is owned by Cubewise CODE Pty Ltd and is protected by copyright law. You may not copy, modify, merge, distribute, or reverse-engineer the Software except as expressly permitted under this agreement.
Disclaimer of Warranty
The Software is provided "as is" without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event shall the Vendor be liable for any claim, damages, or other liability arising from the use of the Software.
Trademarks
Cognos, TM1, and Planning Analytics are trademarks of IBM. Windows and related product names are trademarks of Microsoft. All other product names are trademarks of their respective owners.
Governing Law
This EULA is governed by the laws of New South Wales, Australia. Any disputes arising under this agreement shall be subject to the exclusive jurisdiction of the courts of New South Wales.
